Action in the St. Louis County District Court for personal injuries sustained by Roger Hanson when the automobile in which he was a passenger, driven by defendant William Bailey, collided with an obstruction allegedly placed on the highway by defendants Morse Brothers and Associates, Inc., and Jay W. Craig Company. Each of the defendants filed a cross-claim. The case was tried before J. K. Underhill, Judge, and a jury. The court found that the defendant Bailey was negligent and that his negligence was a cause of the accident. The jury found, in a special verdict, that the other defendants were negligent; that such negligence was a cause of the accident; and that plaintiff sustained damages in the amount of $6,750. Defendants each appealed from the judgment entered. The parties stipulated that the appeals in the Roger Hanson case (Nos. 37,010 and 37,016) would determine appeals in other cases involving the same accident. (Nos. 37,009, 37,011, 37,015, and 37,017).
